I disagree. You should be able to say it. If I can prove it has caused
me damage, then I should be able to require you to either prove the
statement true, or compensate me for the damage caused.

Basically there are two solutions to false witness:

1) Remove freedom of speech.

2) Keep freedom of speech, but make people legally responsible for the
consequences of their exercise of it.
